60 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO <br />A~ AMENDMENT TO THE AGREEMENT WITH HAMPTON ROADS <br />SANITATION DISTRICT DATED MARCH 26, 1986 FOR THE SALE OF <br />CERTAIN CITY SANITARY SEWAGE FACILITIES. <br /> <br /> WHEREAS, pursuant to a resolution adopted by the <br />Portsmouth City Council September 10, 1985, the City <br />Manager entered into an agreement with Hampton Roads <br />Sanitation District, dated March 26, 1986, for the sale <br />of the Pinners Point Sewage Treatment Plant and certain <br />sewage transmission mains and other sewage facilities; <br />and <br /> <br /> WHEREAS, said agreement was contingent upon certaia <br />financial approvals by the Virginia State Water Control <br />Board and the United States Environmental Protection <br />Agency; and <br /> <br /> WHEREAS, Hampton Roads Sanitation District has <br />requested that said agreement be amended to delete the <br />financial contingencies and approvals; and <br /> <br /> WHEREAS, said amendment is deemed to be in the best <br />interest of the City. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia, that the City Manager <br />be, and he hereby is, authorized to enter into an <br />amendment to the agreement with Hampton Roads Sanitation <br />District dated March 26, 1986, to delete the <br />contingencies with respect to financial approvals for <br />the sale of certain City sanitary sewage facilities. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held June 10, 1986. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
