AN ORDINANCE TO AMEND SECTIONS 40-102 (E) (7), 40-102 (F) <br />(3) AND SECTION 40-102 (I) (2) OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO OFF-STREET <br />PARKING AND OFF-STREET LOADING REQUIREMENTS IN THE HISTORIC <br />DISTRICTS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That Section 40-102 (E) (7), 40-102 (F) (3) and <br />40-102 (I) (2) of the Code of the City of Portsmouth, <br />Virginia, 1973, be amended and reordained to read as <br />follows: <br /> <br />Section 40-102. Historic District and Sub-Districts; <br /> building regulations. <br /> <br /> (E) The following off-street parking requirements <br />shall apply in the Historic District: <br /> <br /> (7) Upon application, the City Planning <br />Commission may, at a regular monthly meeting, consider <br />recommending a special exception for all permitted uses in <br />the Park View Historic District. The Commission shall take <br />into account the relationship of such plot to other spaces <br />and structures located in, or proposed for the Zoning <br />District and in arriving at its recommendation may cite <br />comprehensive plan elements relative thereto. The <br />Commission shall forward to the City Council a written <br />report setting forth the extent to which requirements will <br />be altered by special exception and justifications <br />therefor. Upon considering such Planning Commission <br />recommendation, the City Council may, at a regularly <br />scheduled meeting, grant a special exception, the terms of <br />which shall be specified and performance guaranteed within <br />a specific time. <br /> <br />(F) Off-Street loading requirements are as follows: <br /> <br /> (3) Upon application the City Planning <br />Commission may, at a regular monthly meeting, consider <br />recommending a special exception reducing the required <br />off-street loading requirements in Park View. The <br />Commission shall take into account the relationship of such <br />plot to other spaces and structures located in, or proposed <br />for the Zoning District and in arriving at its <br />recommendation may cite comprehensive plan elements <br />relative thereto. The Commission shall forward to the City <br />Council a written repcrt setting forth the extent to which <br />requirements will be altered by special exception and <br />justifications therefor.
