1987-93 AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 40-140 (C), PERTAINING TO PRESERVATION P-1 DISTRICT DIMENSIONAL REQUIREMENTS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 40-140 (c) of the Code of the City of Portsmouth, Virginia, 1973, be amended and reordained to read as follows: Section 40-140. Preservation P-1 Dimensional Requirements. Within the Preservation P-1 District, all the following dimensional requirements shall be complied with: (c) Minimum required front, rear and side yards - fifty (50) feet. However, upon application, the City Planning Commission may, at a regular monthly meeting, consider recommending a special exception to the minimum required front, rear and side yards requirement for those uses permitted upon the granting of a use permit as provided in ~40-82 (b). The Commission shall take into account the relationship of such a use to other uses and structures located in, or proposed for this zoning district in arriving at its recommendation and may site comprehensive plan elements relative thereto. The Commission shall forward to the City Council a written report setting forth the extent to which the required front, rear and side yards requirements will be altered by special exception and justification therefor. Upon considering such Planning Commission recommendation, the City Council may, at a regularly scheduled meeting, grant a special exception, the terms of which shall be specified and performance guaranteed within a specific time. 2. This ordinance shall take effect on the date of its adoption. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held November 24, 1987. Teste: City Clerk
