AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 40-99 THEREOF, PERTAINING <br />TQ CERTIFICATES OF APPROPRIATENESS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that ~40-99 of the Code of the City of Portsmouth, <br />Virginia, 1973, be amended and reordained to read as follows: <br /> <br />Section 40-99. <br /> <br />Approval or disapproval of plans an~ <br />specifications; issuance of Certificate <br />of Appropriateness; issuance of permit; <br />~xpiration of Certificate of Appropriate- <br />ness. <br /> <br /> Upon receipt of an application for a Certifica~'e 0f <br />Appropriateness required by ~40-96 and the plans and <br />specifications, the Commissioner shall confer with the <br />applicant for the Certificate of Appropriateness, and shall <br />approve, or disapprove such plans and specifications, and if <br />approved shall issue a Certificate of Appropriateness therefor <br />with or without conditions, or with such modifications of the <br />plans and specifications as the Commission deems necessary to <br />execute the purposes and objectives declared in §40-92 and to <br />require compliance with the regulations and restrictions set <br />out in this Article; otherwise the Commission shall reject <br />such plans and specifications and shall not issue the <br />Certificate of Appropriateness. The failure of the Commission <br />to approve or disapprove such plans and'specifications with or <br />without conditions or modifications, within sixty (60) days <br />f~om the date of application for the Certificate of <br />Appropriateness shall be deemed to constitute approval of the <br />plans and specifications as submitted, and the building <br />official shall issue any required permit provided the work to <br />be done under th9 pe~t comp~ie~with t~e requirements of the <br />building code or other'~ordinances and laws applicable or <br />relatin~ thereto. A Certificate of Appropriateness shall be <br />valid for a one (1) year period from the date of issuance. <br />All required building permits must be obtained and/or all~ <br />approved work completed within that one (1) year period. The <br />Commission, upon receipt of an application for extension, may <br />grant an extension of its approval for a period of one (1) <br />year if it believes the owner has moved with dispatch to <br />implement the approved improvements. <br /> <br /> fAdopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held October 27, 1987. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
