AN ORDINANCE CLOSING A PORTION OF FIFTH STREET. <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority <br />has made application to vacate, close and discontinue the <br />hereinafter described portion of Fifth Street; and <br /> <br /> WHEREAS, by a resolution of this Council adopted April <br />14, 1987, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the hereinafter <br />described portion of said street and to report in writing <br />whether in their opinion, any, and if any what, inconvenience <br />would result from discontinuing said street; and <br /> <br /> WHEREAS, said viewers have reported in writing, that in <br />their opinion no inconvenience would result from the closing <br />and discontinuing said street. <br /> <br /> NOW, THEREFORE, BE <br />of Portsmouth, Virginia, <br />portion of Fifth Street <br />street. <br /> <br />IT ORDAINED by the Council of the City <br />that the hereinafter described <br />be closed and vacated as a public <br /> <br />FIFTH STREET <br /> <br /> Ail that certain piece or parcel of land, <br />lying and being in the City of Portsmouth, Virginia, <br />being, more particularly described as that portion <br />of Fifth Street bounded on the north by the southern <br />side of Harrison Street and bounded on the south by <br />the northern side of Henry Street. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth <br />hereby reserves unto itself perpetual easements, rights and <br />privileges to install, maintain, operate and replace sanitary <br />sewer mains, drains and storm drains, water mains and <br />laterals, and electric power lines over, under and across the <br />hereinabove-described portion of said street. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held June 23, 1987. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
