Ail parking lots shall be designed and constructed in <br />such a manner that dust, dirt, sand, gravel and similar <br />materials will not be deposited on public streets or <br />rights-of-way. The owner or occupant of any land within the <br />City in which a parking lot exists shall be respcnsible for <br />cleanup operations. The depositing and tracking of dust, <br />dirt, sand, g~avel and similar materials from a parking lot <br />shall be unlawful and shall constitute a nuisance. Whenever <br />it is determined that a nuisance as defined herein exists, the <br />owner or occupant of the site shall be given notice in writing <br />of the existence of the nuisance, and if same is not abated <br />within fifteen (15) days of receipt of said written notice, <br />the City may cause the nuisance to be abated and bill the <br />owner or occupant thereof for all costs incurred thereby. <br /> <br /> In addition, the city engineer may require that <br />unimproved or graveled lots be promptly sealed with Bituminous <br />concrete Portland cement concrete or Bituminous surface <br />treatment (double prime and seal) or be modified at the owner <br />or occupants expense as may be necessary to assure the <br />elimination of the nuisance noted herein. The same <br />requirement may also be imposed on parking lots with paved <br />surfaces which have become neglected or not maintained, thus, <br />causing the nuisance. <br /> <br /> The improvements to parking facilities required in this <br />paragraph (b) may be phased in accordance with a schedule of <br />improvements approved by the city engineer after considering <br />the proposed use of the parking facility including the <br />anticipated number of persons utilizing the area during the <br />period of construction of the parking facility. <br /> <br /> (c) Internal drainage is required for parking lots where <br />the city engineer considers sufficient room to exist for ten <br />(10) or more parked cars in standard configuration and where, <br />in the opinion of the city engineer, the combination of <br />rooftop area and parking lot area will cause sufficient storm <br />water runoff to warrant the requirement. Internal dra.inage is <br />defined to cover all storm water runoff within the property to <br />be developed. This includes rooftops and parking areas. Only <br />the concrete apron between the property line and the curb is <br />allowed to fall to the street. Catch basins for the internal <br />drainage shall be provided in all parking areas outside of the <br />street right-of-way and storm drainage pipe shall extend to <br />the nearest drainage facility of sufficient capacity. These <br />are mandatory ~eauirements except: <br /> <br /> (i) Where underground drainage pipe culverts are not <br />available within one hundred fifty (150) feet of the parking <br />lot and when the developer receives the concurrence of the <br />city engineer with the certified statement and calculations of <br />the developer's registered professional engineer or a licensed <br />(3) (b) land surveyor that no hazard or danger would result <br /> <br /> <br />
