AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 40-31, 40-48 (1) (b) <br />(ii), 40-48 (2), 40-48 (3) (a), (b) AND (c) (i), AND 40-48 <br />(a) i) THEREOF, PERTAINING TO P~RKING LOTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth~ <br />Virginia: <br /> <br /> 1. That Section 40-31 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended by revising the <br />definition of parking space contained therein, such amended <br />definition to read as follows: <br /> <br />Section 40-31. Definition. <br /> <br /> Parking space. The standing storage space for one <br />automobile of not less than nine (9) feet by eighteen feet <br />plus necessary driveway, access and maneuvering space as <br />required by ~40-49. <br /> <br /> 2. That Section 40-48 (1) (b) (ii) of the Code of <br />City of Portsmouth, Virginia, 1973, be amended to read as <br />follows: <br /> <br />the <br /> <br />Section 40-48. General requirements Eot parking lots. <br /> <br />(1 Location parking spaces. <br /> <br />(b) Residential districts: <br /> <br /> (ii) Such parking area shall be screened from <br />any adjoIning premises used or zoned for residential purposes <br />with a solid wall or fence, or a compact evergreen tree or a <br />shrub fence, located on a strip of land not less than five (5) <br />feet in Width. Where any such parking lot abuts a sidewalk or <br />pedestrian way, wheel bumpers shall be placed on the parking <br />lot adjacent to the perimeter curb and properly maintained. <br /> <br /> 3. That Section 40-48 (2) be amended to read as <br />follows: <br /> <br />Section 40-48. General requirements for parking lots. <br /> <br /> (2) No building permit or Certificate of Occupancy shall <br />be issued until a site plan, prepared and stamped by a <br />professional engineer or land surveyor licensed in the <br />Commonwealth of Virginia, has been marked approved by the city <br />engineer. Such site plans shall contain elevations based upon <br />City of Portsmouth datum as furnished by the city engineer. <br />Unless the city engineer shall determine that some deviation <br />necessary to prevent a demonstrable hardship upon the property <br />owner or is in the best interest of the public safety, the <br />site plan shall contain the following minimum requirements: <br /> <br /> <br />
