11 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING OF TWO <br />(2) THREE-STORY STRUCTURES WITH FIFTEEN (15) CONDOMINIUM <br />UNITS ON .44 ACRES ON THE NORTHERN SIDE OF THE 500 BLOCK OF <br />COLUMBIA STREET AND DESIGNATED AS (GHP-86-18). <br /> <br /> WHEREAS, William Morlino, owner, represented by Kirk <br />Berkeley, A.I.A., has made application pursuant to ~40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, for <br />the granting and approval of a group housing project <br />consisting of fifteen (15) units contained in two (2) <br />three-story buildings located on the northern side of the <br />500 block of Columbia Street (Tax Map 13, Parcels 51, 52, <br />53, 55, 56, 66 and 67) and designated as GHP-86-18; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed said <br />application and site plans submitted therewith and has <br />recommended a conditional approval of same; and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of a group housing project pursuant to §40-55 grants only <br />and exemption from certain requirements for residences as <br />stated in said section, and does not constitute a waiver of <br />any other requirement embodied in the Subdivision <br />Ordinance, Zoning Ordinance, Code of the City of <br />Portsmouth, Virginia, or any other applicable local, state <br />or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits <br />or any other required permit will be issued only upon <br />compliance with the ordinances, laws, or regulations <br />applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia that the certain group housing <br />project described a~ove and designated as GHP-86-18 and <br />more specifically described in correspondence from Kirk <br />Berkeley, A.I.A., dated November 5, 1986 as shown on plans <br />designated "Morlino Condominium" filed with the appropriate <br />officials of the City of Portsmouth, Virginia, such being <br />made a part hereof, is hereby granted approval subject to <br />the following terms and conditions: <br /> <br /> <br />
