AN ORDINANCE TO AMEND SECTION 6-8 AND SECTION 6-17 OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, <br />PERTAINING TO BUILDINGS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 6-8 Subsection 118.1.1 (a), (e), and <br />(f); Section 118.31 (a) (7) (1), 118.31 (a) (7) (2) and <br />118.31 (c); and 118.61 (1) and (2) and (3); and Section 118.9 <br />(1) and (2); and 118.10 (a); and 118.11 (b), (c), (d), and <br />(e); and 118.13 (a) and (b) and (c); and that Section 6-17 <br />(b) (2) be amended and reordained to read as follows: <br /> <br />Section 6-8 Subsection 118.1.1 (a). Failure to obtain a <br /> permit. <br /> <br /> If any person commences any work on a building or <br />structure or any of the component parts thereof, including <br />but not limited to electrical, plumbing, and mechanical <br />features and/or fixtures, or signs, before obtaining the <br />necessary permit from the appropriate division of the <br />Department of Building Inspection; or after obtaining such <br />permit executes the work without calling for and receiving <br />inspections from the appropriate division of the Department <br />of Building Inspection; or after obtaining such permit, <br />deviates from the plan approved by the Department of Building <br />Inspection without receiving written approval from the <br />Building Official; or allows the occupancy of the building <br />or structure for which the permit was obtained before a <br />certificate of occupancy has been issued by the Building <br />Official; then said person shall be guilty of a misdemeanor <br />and subject to the penalty prescribed by the Virginia Uniform <br />Statewide Building Code. In addition to any criminal <br />penalties and sanctions where the unlawful acts described <br />above have been identified before a permit is obtained, <br />an administrative fee of Seventy Five Dollars ($75.00) shall <br />be paid by said person to the City of Portsmouth, as well as <br />the permit fee due. <br /> <br />Section 6-8 Subsection 118.1.1 (e). Inspections. <br /> <br /> The inspections required under the provisions of this <br />Code shall be performed by an inspector from the appropriate <br />division of the Department of Building Inspection, upon <br />notification from the permit holder or such holder's agent. <br />Such inspector shall either approve that portion of the work <br />as completed or shall notify the permit holder or the agent <br />of same where such work fails to comply with the Code or <br />departmental regulation.
