ARTICLE VII. ENFORCEMENT <br /> <br />33-101 VIOLATIONS AND PENALTIES <br /> <br />(a) Any of the following shall be a violation of this chapter <br />and shall be subject to the enforcement remedies and penalties <br />provided by this Chapter and by state law: <br /> <br /> (1) To subdivide land without any and all necessary <br /> approvals under this Chapter. For purposes of <br /> this Chapter, subdividing land shall include any <br /> efforts to subdivide land, however preliminary, <br /> including, but not limited to selling or offering <br /> to sell part of such land~ <br /> <br /> (2) To engage in any development, use, construction, or <br /> other activity of any nature in any way inconsistent <br /> with any subdivision plat, variance or other action <br /> approved under this Chapter; <br /> <br /> (3) To violate, by act or omission, any te.~m, condition, <br /> or qualification placed by the city upon a required <br /> subdivision plat or other approval under this <br /> Chapter; <br /> <br /> (4) To erect, construct, reconstruct, alter, maintain or <br /> use any building or structure or to use any land in <br /> violation or contravention of any zoning, <br /> subdivision or general regulation of this Chapter or <br /> any amendment thereto; <br /> <br /> (5) To continue any of the above stated violations. <br /> <br />(b) The <br /> (1) <br /> <br />(2) <br /> <br />following provisions shall be effective: <br /> <br />No person shall subdivide land without making and <br />recording a plat of such subdivision and without <br />fully complying with the provisions of this Chapter. <br /> <br />No such plat of any subdivision shall be recorded <br />unless and until it shall have been submitted to <br />and approved by the Planning Commission or by the <br />City Council or its duly authorized agent, wherein <br />the land or any part thereof to be subdivided is <br />located. <br /> <br />PORTSMOUTH SUBDIVISION ORDINANCE -- PAGE 38 <br /> <br /> <br />
