(3) <br /> <br />(4) <br /> <br />No person shall sell or transfer any land of a <br />subdivision, before such plat has been duly ~Dproved <br />and recorded as provided herein, unless such <br />subdivision was lawfully created prior to the <br />adoption of a subdivision ordinance applicable <br />thereto, provided, that nothing here contained shall <br />be construed as preventing the recordation of the <br />instrument by which such land is transferred or <br />the passage of title as between the parties to the <br />instrument. <br /> <br />Any person violating the foregoing provisions of <br />this Chapter shall be subject to a fine of not more <br />than five hundred dollars for each lot or parcel of <br />land so subdivided or transferred or sold; and <br />the description of such lot or parcel by metes and <br />bounds in the instrument of transfer or other <br />document used in the process of selling or trans- <br />ferring shall not exempt the transaction from <br />such penalties or from the remedies herein provided. <br /> <br />33-102 ENFORCEMENT AND REMEDIES <br /> <br /> Any violation or attempted violation of this Chapter or <br />of any condition or requirement adoDted pursuant hereto may be <br />restrained, corrected, or abated as the case may be by <br />injunction or other appropriate proceeding pursuant to <br />Virginia Code Section 15.1-499 (1950, as amended). <br /> <br />(a) <br /> <br />The City may institute any appropriate action or <br />proceeding to prevent violations of this Chapter, <br />or the unlawful use of land, to ~estrain, correct <br />or abate such violations, to prevent the subdivision <br />and/or use or occupancy of said land, or to prevent <br />any illegal act, conduct, business, or use in or <br />about such premises or land. <br /> <br />(b) <br /> <br />Whenever in this Chapter, any act is prohibited or <br />is made or declared to be unlawful or an offense, <br />or wherever in this Chapter, the doing of any act <br />is required or the failure to do any act is declared <br />to be unlawful or an offense, the violation of same <br />shall be punished as provided for in Section 33-101 <br />(b)(4). Each and every day any violation of this <br />Chapter shall continue, shall, except as otherwise <br />provided, constitute a separate offense. <br /> <br />(c) <br /> <br />The City may stop work on any development, <br />excavation, building or structure, on any land on <br />which there is or has been an uncorrected violation <br />of a provision of this Chapter or of a permit or <br />other form of authorization issued hereunder in <br /> <br />PORTSMOUTH SUBDIVISION ORDINANCE -- PAGE 39 <br /> <br /> <br />
