New open ditches or <br />modification of existing ditches will not be <br />p~rmitted in area~ zoned residential unless <br />included in the City's mas~er drainage plan. <br /> <br />(2) The City Engineer will determine whether a <br />hazard or danger exists from such additional <br />off-site drainage flow by approved drainage <br />computations furnished to %he City Engineer by the <br />pemmit applicant in accordance with the City's <br />mae%er drainage plan, existing field conditions and <br />zoning required Dy City Council. Computations <br />shall be ba~ed on a normal storm re~urn period of <br />five (5) years using U.S. Department of Commerce <br />curves and utilizing applicable existing master <br />drainage plans on file in the office of the City <br />Engineer, or as ad3usted by the City. Where <br />reasonably necessary to pro%eot public or private <br />p~oper%y, the City Engineer may require calculation <br />of drainage flow end installation of improvements <br />based on a normal s~orm return period of greater <br />than five years. <br /> <br />(3) After the City Engineer determines no hazard <br />or danger results from additional off--site drainafe <br />flow, the Buildinf Official wilt issue a building <br />permit if other requirements are me~. <br /> <br />(4) When the City Engineer determines that <br />hazard or danger results from additional off-site <br />drainage flow, and all othe~ legal mandates are <br />me~, the building permit will be issued only after: <br /> <br />(i) A plan is submitted by t~e permit applicant <br />~o provide the off--site drainage and is <br />approved Dy the City Engineer and the permit <br />applicant agrees %0 ¢ons~ruc~ such approved <br />off-site drainage pursuan= to the bonding or <br />other financing procedures sez ou% in Section <br />33--32 of this Code. <br /> <br />(ii) The City Council, at its discretion, <br />independently or in con,unction with the permit <br />applicant, may agree to construe= suc~ app=oved <br />drainage facilities; provided that in areas <br />zoned residential, the City will cons%ruc~ such <br />facilities usin~ nonlocal funds only. <br />(Nonlocal fund~ are'those received by t~e City <br /> <br />PORTSMOUTH SUBDIVISION ORDINANCE ---- PAGE 19 <br /> <br /> <br />
