site; is built on a permanent chaises; is designed to be used <br />as a single family dwelling, with or without a permanent <br />foundation, when connected to required utilities; and includes <br />the plumbing, heating, air conditioning, and electrical <br />systems contained in the structure. <br /> <br /> 3. That the Code of The City of Portsmouth be amended by <br />adding Section 40-67.2 to read as follows: <br /> <br />Section 40-67.2 Protection of surface water and groundwater. <br /> <br /> Any owner who erects, constructs, opens, reopens, ex~ands <br />or employs new processes in or operates any establishment from <br />which there is a potential or ~ctual discharge of industrial <br />wastes or other wasses to surface water or groundwater as <br />defined in Section 62.1-44.85 (8), Code of Virginia, shall, <br />prior to obtaining any zoning amendment, special exceptIon or <br />use permit or any building or other permit for such facility <br />or establishment submit to the Director of Public utilities <br />pertinent plans, specifications, maps and such other relevant <br />information as may be required, in scope and detail <br />satisfactory to the director setting forth plans for control <br />of such industrial wastes and other wastes and p~otection of <br />surface water and groundwater. Such plans shall be subject to <br />approval by the Director of Public Utilities which approval <br />shall not be inconsistent with standards set forth by the <br />State Water Control 8card. Such approval by the Director of <br />Public Utilities shall not preclude the necessity of obtaining <br />applicable permits from the State Water Control Board for such <br />establishment or facility. <br /> <br /> 4. That Section 40-101 of the Code of the City of <br />Portsmouth be amended to read as follows: <br /> <br />Section 40-101. <br /> <br />Certain detailed designs, interior <br />arrangements or features of a building, <br />not to be considered by Commission. <br /> <br />etc., <br /> <br /> The Commission shall not consider detailed designs, <br />interior arrangements or features of a building or structure <br />which are not subject to public view from a public street, <br />public way or other public place, and shall not make any <br />requ~remen[s except for the purpose of preventing development <br />incongruous to the historic aspects of the surroundings and <br />the Historic District. The Commission shall not consider the <br />construction of a ramp to serve the handicapped at any <br />structure or building in the Historic District. <br /> <br /> 5. That Section 40-123 (d) of the Code of the City of <br />Portsmouth be amended to read as follows: <br /> <br /> <br />
