AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, BY AMENDING SECTION 40-1 PERTAINING TO PURPOSE OF <br />ZONING ORDINANCE; SECTION 40-31 THEREOF PERTAINING TO THE <br />DEFINITION OF MANUFACTURED HOMES; ADDING SECTION 40-67.2 <br />PERTAINING TO PROTECTION OF SURFACE WATER AND GROUNDWATER; <br />AMENDING SECTION 40-101 AND 40-123 (d) PERTAINING TO RAMPS FOR <br />THE HANDICAPPED IN HISTORICAL ZONES; AND D-1 ZONES AND <br />AMENDING SECTION 40-254 PERTAINING TO APPEALS TO CITY COUNCIL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-1 of the Code of the City of <br />Portsmouth be amended to read as follows: <br /> <br />Section 40-1. Purpose. <br /> <br /> The zoning regulations and district as herein set forth <br />have been in accordance with a comprehensive plan and design <br />to promote the health, safety or general welfare of the public <br />and further to provide for adequate light, air, convenience of <br />access, and safety from fire, flood and other dangers; to <br />reduce or prevent congestion in the public streets; to <br />facilitate the creation of a convenient, attractive and <br />harmonious community; to expedite the provision of adequate <br />police and fire protection, disaster evacuation, civil <br />defense, transportation, water, sewage, flood protection, <br />schools, parks, forests, playgrounds, recreational facilitiest <br />airports and other public improvements; to protect against the <br />destruction of or encroachment upon historic areas; to protect <br />against one or more of the following: overcrowding of land, <br />undo density of population in relation to the community <br />facilities existing or available, obstruction of light and <br />air, danger and congestion in travel and transportation, or <br />loss of life, health or property from fire, flood, panic or <br />other dangers; and to encourage economic development <br />activities that provide desirable employment and enlarge the <br />tax base; and for protection of surface water and ground <br />water. <br /> <br /> 2. That Section <br />Portsmouth be amended <br />manufactured homes to <br /> <br />40-31 of the Code of the City of <br />by adding thereto the definition <br />read as follows: <br /> <br />of <br /> <br />Section 40-31. Manufactured homes. <br /> <br /> A structure subject to <br />transportable in one or more <br />more in width and forty body <br />traveling mode, or is 320 or <br /> <br />Federal regulation, which is <br />sections; is eight body feet or <br />feet or more in length in the <br />more square feet when erected on <br /> <br /> <br />
