AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 40-55 (6) (b) THEREOF, <br />PERTAINING TO GROUP HOUSING PROJECT REVIEW. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-55 (6) (b) of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 40-55. Group Housing Project Review. <br /> <br />(6) <br /> <br /> (b) If a developer has not applied for building <br />permits for the entire approved group housing project in one <br />(1) year of City Council approval, such approval shall be <br />deemed expired to that portion of the approved project for <br />which building permits have not been issued. However, the <br />developer may petition the City Planning Commission for an <br />extension of such approval for a period of one (1) year. Such <br />petition shall be filed prior to the expiration of the group <br />housing project, provided, however, the developer may file <br />such petition within ninety (90) days immediately following <br />the expiration provided for herein. The City Planning <br />Commission shall grant such extensIon if it believes the <br />developer has moved with dispatch to execute the approved <br />project. <br /> <br /> 2.
