A RESOLUTION GRANTING A USE PERMIT TO WESLEY FRYE TO OPERATE AN AUTOMOBILE STORAGE YARD AT 3409 DEEP CREEK BOULEVARD. WHEREAS, Wesley Frye has made application pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, amended, for the granting of a use permit as hereinafter-described; and as WHEREAS, the applicant and the Planning Director have done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property and improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Wesley Frye is hereby granted a use permit pursuant to §40-71 (b) of the Code of the City of Portsmouth, Virginia to operate an automobile storage yard at 3409 Deep Creek Boulevard and certain city owned property adjacent thereto, such properties being more specifically described ~s Tax Map 473, Parcel 1 and .396 acres on Tax Map 151, Parcel 3 (UP-88-1), such parcels being designated as Parcel 1 and Parcel 2 and being more particularly described as follows: Parcel 1 - Property of Wesley Frye BEGINNING on the east side of Deep Creek Boulevard 210' north from its intersection with Elliott Avenue; thence northerly along Deep Creek Boulevard 185' + to a point; thence easterly 65' ~; thenc~ southeast 160' ~; thence westerly 144' to the east right-of-way of Deep Creek Boulevard, the Point of Origin.
