Section 40-122. Certificate of Intent. <br /> <br /> (a) In order to regulate building and development within <br />the D-1 and D-2 Districts in accordance with the adopted plan <br />and program, the Design Committee will provide the basic <br />guidelines for prospective developers, builders, designers, <br />etc., as part of a formal review process. The specifications <br />shall be based on the adopted plan and the design guidelines <br />adopted by City Council. The review process shall culminate <br />in the issuance of a Certificate of Intent by the Committee to <br />the applicant which shall contain specifications for use, <br />building, height, bulk, location (with set-back requirements), <br />required number of parking spaces, landscaping requirements, <br />signs, and other design features to be incorporated. <br /> <br />Section 40-123. Certificate of Compliance. <br /> <br /> (a) Before any modifications, alterations, <br />reconstruction, construction, repair, maintenance activity, <br />including painting of an outer wall or part of a building or <br />structure which are subject to public view from a public <br />street, public way or other public place, occurs in the <br />Downtown Districts, the plans therefor shall be reviewed by <br />the Design Committee. Whenever any person shall apply for a <br />building permit in such area, a copy of the plans shall be <br />filed with the Committee for review. <br /> <br /> (b) Application for a Certificate of Compliance to <br />externally repair, maintain, paint, locate, construct, <br />reconstruct, alter or demolish a building, structure, or any <br />other improvement in the Downtown Districts shall be made to <br />the Downtown Design Committee in writing by the owner or the <br />legal agent of such building, structure or property. The <br />application shall be accompanied by plans and specifications <br />of the improvements, building or structure which are or will <br />be subject to public view from a public street, public way or <br />public place. Such plans shall show general design, <br />arrangement, texture, materials, planting and color proposed <br />to be used in external repair, maintenance, painting, <br />location, construction, reconstruction, or alteration of the <br />building, structure or improvements and the type windows, <br />exterior doors, lights and lighting fixtures, signs, parking <br />lot and treatment, landscaping and other fixtures an~ <br />appurtenances which will be subject to public view from a <br />public way, street or place. <br /> <br /> (c) Nothing in this chapter shall be construed to <br />prevent the owner of such building, structure or property in <br />the D-1 or D-2 Districts from performing any maintenance, <br />alteration or painting to the external architectural features <br />of such building, structure or property which does not involve <br />a change in design, material, color or the outward appearance <br />thereof, and which maintenance, painting or alteration is of <br /> <br /> <br />
