The Commission shall take into account the <br />relationship of such a plot to other spaces and structures <br />located in, or proposed for this zoning district and arriving <br />at its recommendation and may cite comprehensive plan elements <br />relative thereto. The Commission shall fcrward to the City <br />Council a written report setting forth the extent to which <br />restrictions will be altered by special exception and <br />justification therefor. Upon considering such Planning <br />Commission recommendation, the City Council may, at a <br />regularly scheduled meeting, grant a special exception, the <br />terms of which shall be specified and performance guaranteed <br />within a specific time. <br /> <br /> The Downtown Design Committee shall review and approve <br />design and landscaping of newly constructed parking lots. <br /> <br /> Not withstanding any other provisions of this chapter, <br />whsnever (i) there exist a lot with one or more structures on <br />it constructed before the effective date of this Article, and <br />(ii) there is a change in use that does not involve any <br />enlargement of a structure on such lot, and (iii) the parking <br />requirements of this section that would be applicable as a <br />result of the change in use cannot be satisfied on such lot <br />because there is not sufficient area on the lot that can be <br />used for parking, then the property owner need only comply <br />with the requirements of this section to the extent that (i) <br />parking space is available on such lot and (ii) off-street <br />parking spaces are available as provided in ~40-48 (I). <br /> <br /> (v) Off-street loading: Space for this function shall <br />be provided as specified in ~40-49. <br /> <br /> (vi) Minimum required floor area for a dwelling unit <br />exclusive of garages and patios: Six hundred (600) square <br />feet. <br /> <br /> <br />
