AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 33-2, 33-17, 33-20 (b), 33-52, 33-55 (a), 33-60, 33-71 (e), AND 33-73 THEREOF, AND ADDING SECTION 33-21 .THERETO, PERTAINING TO SUBDIVISIONS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 33-20 (b), 33-52, 33-55 33-71 (e), and 33-73 of the Code of the City of Virginia, 1988, be amended to read as follows: (a), 33-60, Portsmouth, Section 33~20. Lots. (b) Where no public sewer is available, the average width shall not be less than seventy-five (75) feet and %he area not less than ten thousand (10,000), square feet for each dwelling unit. Section 33-52~ Application for preliminary plat approval. After preapplication review as required by Section 33-51 has been completed, the subdivider shall apply in writing to the planning commission and submit a preliminary plat, in accordance with Article IV of this Chapter. To receive consideration at the next meeting of the planning commission, the application and preliminary plat shall be filed not less than twenty-one (21) days prior to such meeting. Section 33-55. Final plat approval. (a) The subdivider shall, within one year after preliminary plat approval by the Planning Commission, apply in writing for approval of the final subdivision plat and submit for file ten (10) paper copies of the plat and one reproducible tracing of the plat; and he shall submit a fee with the application as required by Article V of this Chapter. Section 33-60. Variance procedure. The following procedure shall apply to requests for variances from the subdivision ordinance as described in Section 33-36. (1) At any stage of the application process for approval of a subdivision up to and including the submission of the final plat, the applicant may request the planning commission to vary the regulations prescribed in this chapter.
