AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, BY AMENDING SECTION 32-29 THEREOF, PERTAINING <br />TO BARBWIRE FENCES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that Section 32-29 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended as follows: <br /> <br />Section 32-29. Barbed or razor wire. <br /> <br /> No barbed or razor wire shall be used for the purpose of <br />wholly or partially enclosing any lot or premises within the <br />City, excep~ that barbed ends of fences, barbed wire and razor <br />wire, may be used on top of any wall or fence wholly or <br />partially enclosing any lot or premises in any commercial or <br />industrial district, as defined by Zoning Ordinance, and <br />barbed wire may be used on top of any wall or fence wholly or <br />partially enclosing any public school, park, recreational or <br />playground site in any residential, commercial or industrial <br />district, provided that such wall or fence is at least six (6) <br />feet in height, that the barbed wire or razor wire is <br />installed on arms or brackets extending from the top of such <br />wall or fence inwardly over the private properny to be wholly <br />or partially enclosed, that not more than three (3) strands of <br />barbed wire shall be so installed, and the first strand shall <br />be at least six (6) inches from the face of the wall or fence. <br /> <br /> Any person violating any provision of this section shall <br />be guilty of a Class 4 Misdemeanor, and in addition thereto, <br />shall pay the expense of removing the barbed or razor wire <br />from the fence or wall in question. <br /> <br /> This ordinance shall take effect from the date of its <br />adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held August 22, 1989. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
