AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA, 1988, AS AMENDED, BY AMENDING SECTIONS
<br />24-42, 24-74, 24-198, 24-276, 24-289, 24-317, AND 24-363 AND
<br />BY REPEALING SECTION 24-319 THEREOF PERTAINING TO
<br />MISCELLANEOUS OFFENSES.

<br /> BE IT ORDAINED by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That Sections 24-42, 24-74, 24-198, 24-276, 24-289,
<br />24-317, and 24-363 of the Code of Portsmouth, Virginia, 1988,
<br />be amended to read as follows:
<br />
<br />Section 24-42. Sale of certain substances to
<br /> minors-Generally.
<br />
<br /> (a) It shall be unlawful for any person to knowingly
<br />sell or.otherwise distribute, without prescription, to a minor
<br />any pill, capsule or tablet containing any combination of
<br />caffeine and ephedrine sulfate.
<br />
<br /> (b) A violation of this section shall be punishable as a
<br />Class 1 misdemeanor.
<br />
<br />Section 24-74. Carrying concealed weapon-Generally.
<br />
<br /> (d)(5) Law enforcement agents of the Armed Forces of the
<br />United States and federal agents who are otherwise authorized
<br />to carry weapons by federal law while engaged in the
<br />performance of their duties.
<br />
<br />Section 24-198. Obscene items enumerated.
<br />
<br />Obscene items sh~ll include:
<br />
<br />1) Any obscene book; or
<br />
<br />2)
<br />
<br />Any obscene leaflet, pamphlet, magazine, booklet,
<br />picture, painting, drawing, photograph, film,
<br />negative, slide, motion picture, videotape
<br />recording; or
<br />
<br />3)
<br />
<br />Any obscene figure, object, article, instrument,
<br />novelty, device, or recording or transcription
<br />used or intended to be used in disseminating any
<br />obscene song, ballad, word or sounds.
<br />
<br />Section 24-276. Obstructing justice by threats or force.
<br />
<br /> (a) If any person without just cause knowingly obstructs
<br />a judge, magistrate, justice, juror, witness or any law
<br />enforcement officer in the performance of his duties as such
<br />
