to Section 46.1-423.3 of the Code of Virginia, the court shall not suspend the entire jail sentence in any case but may, in its discretion, suspend a portion thereof. However, this provision, in the discretion of the court, shall not apply if the operation of the motor vehicle was due to an emergency involving danger to the health or life of any person or to property; and the court may, in its discretion, prescribe that the jail sentence shall be served at such time or times as the court may direct after considering the circumstances of the person convicted of violating this section. Section 22-423. Chemical test to determine alcoholic or drug content of blood. The provisions of Section 18.268[A) through (Z) of the Code of Virginia in effect on July 1, 1989, are hereby incorporated by reference and adopted as a part of this section. 2. That Section 22-688 be added to the Code of the City of Portsmouth, Virginia, 1988, to read as follows: Section 22-688. Mopeds; Safety devices for protection of operator and passengers. Every person operating a moped on a public street or highway shall wear a face shield, safety glasses, or goggles of a type approved by the Superintendent or have his moped equipped with safety glass or a windshield at all times while operating such vehicle, and operators and passengers thereon, shall wear protective helmets of a type approved by the Superintendent. Any person who knowing~y violates any such ordinance shall be guilty of a traffic infraction and be subject to a fine of not more than fifty dollars. 3.
