Parcel 3 (R-75-K Residential Conditional) <br /> <br /> BEGINNING at a point 419.59' south from the <br />southwest intersection of High Street, West and <br />Garland Drive and thence 225' west to establish <br />the true pcint of beginning; thence southwest <br />727.96' to the center line of Sterlina Point <br />Creek; thence in a westerly direction following <br />said creek center line a distance of 1,243.62' to <br />the east right-of-way of Seaboard Coast Line <br />Railroad; thence north along said right-of-way <br />751.16'; thence east 1,050' + to the point of <br />beginning, from Residential ~-150 to Residential <br />R-75-K Conditional. <br /> <br /> 3. Zoning Ordinance Amendment Z-88-13 is conditioned <br />upon the following: <br /> <br /> (a) The development of the property shall be in <br />accordance with and subject to the terms of the Development <br />Agreement entered into between the City of Portsmouth, <br />Industrial Development Authority of the City of Portsmouth, <br />Realty Equities, Inc. and Salasky-Sedel, Inc. and any <br />amendments thereto. <br /> <br /> (b) Parcel 2 shall include low rise campus style <br />professional and medical office space containing <br />not more than thirty thousand (30,000) gross leasable square <br />feet and building heights shall not exceed two stories. <br /> <br /> (c) A fifty (50) foot building side yard along <br />Garland Drive shall be maintained and said side yard shall <br />be used only in a passive manner and include landscaping and <br />an eight (8) foot wall. No dumpsters or parking may be <br />permitted within the fifty (50) foot buffer area. <br /> <br /> (d) On site landscaping as provided shall be <br />maintained in accordance with the Development Agreement <br />noted above. <br /> <br /> (e) No ingress or egress shall be permitted <br />between the developed Churchland High School site and the <br />adjacent Woodbine area. The wall noted above shall be <br />installed to prevent access. <br /> <br /> (f) Parcel 3 residential area shall consist of a <br />residential complex containing not more than one hundred <br />fifty (150) home ownership units and shall not be developed <br />as a rental apartment project. <br /> <br /> <br />
