AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, AS AMENDED, BY ADDING ARTICLE XIII TO CHAPTER 24 THEREOF, PERTAINING TO REGULATION OF SMOKING IN CERTAIN PLACES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Chapter 24 of the Code of the City of Portsmouth, Virginia, 1988, be amended by adding thereto Article XIII to read as follows: ARTICLE XIII. Regulation of Smoking Section 24-430. Definitions. For the purpose of this Article, the following words and phrases shall have the meanings respectively ascribed to them by this section: (a) Bar or lounge shall mean any area or room utilized primarily for the sale of alcoholic beverages for consumption by patrons on the premises and in which the sale of food is merely incidental to the sale of alcoholic beverages. Although a restaurant may contain a bar or lounge area, the terms "bar or lounge area" shall not encompass the entire restaurant or any dining area; (b) Food store shall mean any supermarket or grocery store which is designed and arranged to display food products and which has as its primary business purpose the sale of food products to consumers for consumption off the premises and not for resale, and which derives a substantial portion of its income therefrom; (c) Health care facilities shall mean any office or institution providing individual care and treatment of disease, whether physical, mental or emotional, or other medical, physiological or psychological conditions including but not limited to hospitals, clinics, nursing homes, homes for the aging or chronical ill, laboratories, offices of any physician, dentist, psychologist, psychiatrist, physiologist, podiatrist, optometrist, or optician; (d) Public meeting shall mean any meeting or assembly held in a public building or building leased for public purpose which is opened to the public for the conduct of the affairs of, and the transaction of business by, any legislative or administrative body or agency of the City of Portsmouth, including boards, commissions, authorities, councils, committees, sub-committees and other subordinat~ groups thereof, receiving or expending and supported in whole or in part by public funds;
