AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, AS AMENDED, BY ADDING ARTICLE XIII TO CHAPTER <br />24 THEREOF, PERTAINING TO REGULATION OF SMOKING IN CERTAIN <br />PLACES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Chapter 24 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding thereto <br />Article XIII to read as follows: <br /> <br />ARTICLE XIII. Regulation of Smoking <br /> <br />Section 24-430. Definitions. <br /> <br /> For the purpose of this Article, the following words and <br />phrases shall have the meanings respectively ascribed to them <br />by this section: <br /> <br /> (a) Bar or lounge shall mean any area or room utilized <br />primarily for the sale of alcoholic beverages for consumption <br />by patrons on the premises and in which the sale of food is <br />merely incidental to the sale of alcoholic beverages. <br />Although a restaurant may contain a bar or lounge area, the <br />terms "bar or lounge area" shall not encompass the entire <br />restaurant or any dining area; <br /> <br /> (b) Food store shall mean any supermarket or grocery <br />store which is designed and arranged to display food products <br />and which has as its primary business purpose the sale of food <br />products to consumers for consumption off the premises and not <br />for resale, and which derives a substantial portion of its <br />income therefrom; <br /> <br /> (c) Health care facilities shall mean any office or <br />institution providing individual care and treatment of <br />disease, whether physical, mental or emotional, or other <br />medical, physiological or psychological conditions including <br />but not limited to hospitals, clinics, nursing homes, homes <br />for the aging or chronical ill, laboratories, offices of any <br />physician, dentist, psychologist, psychiatrist, physiologist, <br />podiatrist, optometrist, or optician; <br /> <br /> (d) Public meeting shall mean any meeting or assembly <br />held in a public building or building leased for public <br />purpose which is opened to the public for the conduct of the <br />affairs of, and the transaction of business by, any <br />legislative or administrative body or agency of the City of <br />Portsmouth, including boards, commissions, authorities, <br />councils, committees, sub-committees and other subordinat~ <br />groups thereof, receiving or expending and supported in whole <br />or in part by public funds; <br /> <br /> <br />
