AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 33-2, 33-34, 33-73[8), 33-75(b), AND 33-75(c), THEREOF, PERTAINING TO SUBDIVISIONS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 33-2 of the Code of the City of Portsmouth, Virginia, 1988, be amended by amending the definitions of "SUBDIVISION" and "SUBDIVISION, MINOR" contained therein, to read as follows: Section 33-2. Definitions. SUBDIVISION. The division of a parcel of land into two or more lots or parcels of less than five acres each for the purpose of transfer of ownership or building development, or, if a new street ~s involved in such a division, any division of a parcel of land. Any subdivision to whic~ the city or the Commonwealth of Virginia is a party shall not be deemed a subdivision. SUBDIVISION, MINOR. A subdivision creating not more than three lots fronting on an existing street. A subdivision plat processed for the purpose of adjusting lot lines or creating a plat of an existing parcel of land without actually dividing it shall be processed as a minor subdivision; however, the requirements of Section 33-32 shall not apply. 2. That Section 33-34 of the Code of the City of Portsmouth, Virginia, 1988, be amended by adding Subsection (c) thereto, to read as follows: Section 33-34. Minor Subdivision Standards. (c) If the streets, drainage or utilities for the proposed minor subdivision are not fully improved as required by this chapter, the planning director shall require as conditions of the minor subdivision approval that: (1) Curb, gutter, paving, sidewalks, drainage and utilities be improved to the standards for improvements currently applicable to a subdivision that is not a minor subdivision. These improvements shall be provided as ~equired by Sections 33-32 and 33-33.
