AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 33-2, 33-34, <br />33-73[8), 33-75(b), AND 33-75(c), THEREOF, PERTAINING TO <br />SUBDIVISIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 33-2 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by amending the <br />definitions of "SUBDIVISION" and "SUBDIVISION, MINOR" <br />contained therein, to read as follows: <br /> <br />Section 33-2. <br /> <br />Definitions. <br /> <br />SUBDIVISION. The division of a parcel of land into two or <br />more lots or parcels of less than five acres each for the <br />purpose of transfer of ownership or building development, or, <br />if a new street ~s involved in such a division, any division <br />of a parcel of land. Any subdivision to whic~ the city or the <br />Commonwealth of Virginia is a party shall not be deemed a <br />subdivision. <br /> <br />SUBDIVISION, MINOR. A subdivision creating not more than <br />three lots fronting on an existing street. A subdivision plat <br />processed for the purpose of adjusting lot lines or creating a <br />plat of an existing parcel of land without actually dividing <br />it shall be processed as a minor subdivision; however, the <br />requirements of Section 33-32 shall not apply. <br /> <br /> 2. That Section 33-34 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding Subsection <br />(c) thereto, to read as follows: <br /> <br />Section 33-34. Minor Subdivision Standards. <br /> <br />(c) <br /> <br />If the streets, drainage or utilities for the <br />proposed minor subdivision are not fully improved as <br />required by this chapter, the planning director <br />shall require as conditions of the minor subdivision <br />approval that: <br /> <br />(1) <br /> <br />Curb, gutter, paving, sidewalks, drainage and <br />utilities be improved to the standards for <br />improvements currently applicable to a <br />subdivision that is not a minor subdivision. <br />These improvements shall be provided as <br />~equired by Sections 33-32 and 33-33. <br /> <br /> <br />
