WHEREAS, the developer has been informed that approval of <br />the group housing project pursuant to Section 40-55 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, or <br />any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits and <br />any other required permits will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that the certain group housing project <br />designated as GHP-90-2, and being more specifically described <br />and shown on revised plans designated "The Lanterns at River <br />Pointe by Garcia-Gelardi Development Corporation," dated March <br />9, 1988, prepared by Talbot and Associates, Ltd., and <br />additional plans and documentation furnished on behalf of the <br />developer, all on file with the Planning Department of the <br />City of Portsmouth, Virginia, such plans and documentation <br />being made a part hereof, is hereby granted approval subject <br />to the following terms and conditions: <br /> <br />A revised site plan, landscaping plan and elevations <br />reflectin~ any changes made through the group <br />housing application process, including any changes <br />by City Council, must be submitted to and approved <br />by the Planning Department prior to the issuance of <br />building permits. <br /> <br />The revised site plan must conform <br />requirements of the Chesapeake Bay <br />Areas Overlay (CBPAO) Ordinance and <br />Replacement Ordinance. <br /> <br />to all <br />Preservation <br />the Tree <br /> <br />e <br /> <br />Modifications to the site layout necessary to comply <br />with the CBPAO Ordinance will not require further <br />approval by City Council, provided that: <br /> <br />(a) the development complies with all dimensional <br /> requirements of the Zoning Ordinance; and <br /> <br />(b) the development complies with all provisions of <br /> the site's conditional zoning. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held November 27, 1990. <br /> <br />'Teste: <br /> <br />City Clerk <br /> <br /> <br />
