which parallels the site to reduce the residential noise <br />impacts generated by the acceleration and deceleration of <br />trucks. The buffers shall extend north from the end of <br />the tipping building to the emergency access road shown <br />on the site plan submitted by the applicant and shall <br />extend south from the other end of the tipping area to <br />approximately 200 feet past the southern-most scale. The <br />details of these buffers must be approved by the Planning <br />Department prior to approval of a plan of development <br />(site plan). Muffling devices to control sound produced <br />by safety relief valves shall be in place at all times <br />when the plant is operating, including the testing and <br />start-up phases. The plant management shall comply with <br />any request by the City Manager to reduce sound volumes <br />of the public address system in response to complaints <br />from citizens. Vacuum systems for loading lime for the <br />air pollution control system shall only be operated <br />between the hours of 8:00 a.m. and 5:00 p.m. Monday <br />through Friday, unless approved by the City Manager or <br />his designee on an emergency basis. <br /> <br /> (1) At the request of the City Manager, the <br />operator of the facility shall provide an acceptable <br />noise study which indicates the noise levels generated by <br />the facility in full operation. (The study should be <br />similar to the noise study prepared for Wheelabrator <br />Technologies by Robert M. Earsey, P.E., entitled "Noise <br />Study, Tidewater Trash to Energy Facility, Portsmouth, <br />Virginia.") Noise levels generated by the facility at <br />Victory Boulevard's intersections with Afton Parkway and <br />Channing Avenue shall not exceed 5 decibels above <br />baseline ambient noise levels between the hours of 10:00 <br />p.m. and 7:00 a.m. The baseline level shall be <br />determined by using the logarithmic average Leq value <br />over the period between the hours of 10:00 p.m. and 7:90 <br />a.m. <br /> <br /> (m) The operator of the facility shall process and <br />burn in the facility only such trash, garbage, refuse or <br />municipal solid waste, as is obtained from the <br />Southeastern Public Service Authority (SPSA), or its <br />successor, or as may be authorized to be processed or <br />burned by the City Manager of the City of Portsmouth. <br />The applicant or its assignee(s) or successor(s) shall <br />participate with SPSA in developing procedures for <br />screening hazardous materials, including but not limited <br />to electric batteries, from the supply of materials to be <br />processed at the facility. <br /> <br /> (n) The applicant, or its assiqnee(s) or <br />successor(s) within one hundred and ~ighty (180) days of <br />the adoption of this resolution, or within such <br />additional time as the City Manager or his designee may <br />grant, shall execute an agreement with Southeastern <br /> <br /> <br />
