Public Service Authority (SPSA), or its successor, for <br />the procurement of the trash, garbage, refuse, or <br />municipal solid waste referred to in condition (1) above. <br /> <br /> (o) The facility shall be constructed in accordance <br />with the exterior architectural design and color <br />rendering set out in the document labeled UP-90-13, <br />Exhibit 5. <br /> <br /> (p) The applicant within thirty days of the <br />adoption of this resolution shall execute an agreement <br />with the City to pay up to 25% of the total cost or <br />$300,000.00, whichever is less, for repair or <br />reconstruction of the Paradise Creek B~idge on Victory <br />Boulevard. The cost of repair or reconstruction shall <br />include design and engineering, soil surveys, permit and <br />inspection fees, and any costs involved in securing <br />approval of the Army Corps of Engineers, Virginia Marine <br />Resources Commission, Virginia Department of <br />Transportation, and City of Portsmouth Wetlands Board. <br /> <br /> (q) The applicant, or its assignee(s) or <br />successor(s), shall participate with the City in a plan <br />of public education concerning recycling and in the <br />establishment of recycling centers in the City of <br />Portsmouth. <br /> <br /> (r) The applicant, or its assignee(s) or <br />successorls), shall participate with the citizens of <br />Cradock in the location and installation of community and <br />recreational improvements. <br /> <br /> (s) Prior to commencement of any operation of the <br />facility, the operator of this facility shall provide the <br />City Manager of the City of Portsmouth or his designee, <br />with an emergency evacuation plan and evidence of a fire <br />contingency and supression plan which meets with the <br />approval of the City Manager or his designee(s). <br /> <br /> (t) The plant shall be equipped with a fire <br />supression system adequate to extinguish fires on the <br />tipping floor or in the garbage pit. The plant shall <br />have its own firefighting personnel on duty at al~ times. <br /> (u) If any condition of this use permit is ~or any <br />reason declared inualid by a court of law, such dgcision <br />shall not affect the validity and enforceability ~f the <br />remaining conditions. <br /> <br /> <br />
