remove an official marker or to demolish or alter a building as provided <br />under the Cede, the COmmission Shall at the same time recommend that the <br />building be acquired, leased or otherwise dealt with in accordanCe with law. <br /> <br />(c) <br /> <br />In the event that the comn~Jssion recommends denial, the owner shall be <br />notified immediately not to remove the marker or demolish or alter the <br />building until expiration ef one year from the date of the owner's application <br />filing, <br /> <br />(d) Appeals of decisions concerning marker removal and demolition permits shall <br /> follow Section 40-53.6. <br /> <br />Sec. 40-54. Standards for certificate of appr~p~-~iateness in historic districts. <br /> <br /> Before a certificate of appropriateness is issued by the comn-AssiOn of architectural <br />review, the commission, in addition to Other pertinent factors which may be involved <br />in the fulfillment of the purposes and objectives declared in Section 40-51 shall <br />consider: <br /> <br />(a) <br /> <br />The historical or architectural value and significance of the building or <br />structure and its relationship to or congruity with the historic value of the <br />land, place and area in the historic district upon which it is <br />proposed to be located, constructed, reconstructed, altered or <br />repaired; <br /> <br />(b) <br /> <br />(c) <br /> <br />The appropriateness of the exterior architectural features of such building <br />or structure to such land, place or area and its relationship to or congruity <br />with the exterior architectural features of other land, places, areas, <br />buildings or structures in the historic district and environs; and <br /> <br />The general exterior design, arrangement, texture, materials, planting and <br />color proposed to be used in the location, construction, reconstruction, <br />alteration or repair of the building, structure or improvement and type of <br />windows, exterior doors, lights, landscaping, parking and other exterior <br />fixtures and appurtenances which will be subject to public view from a <br />public street, public way or other public place and their relationship to or <br />congruity with other factors to be considered by the commission under this <br />section. <br /> <br />(d) <br /> <br />The commission shall not consider detailed designs, interior arrangements <br />or features of a building or structure which are not subject to public view <br />from a public street, public way or other public place, and shah not make <br />any requirements except for the purpose of preventing developments <br />incongruous to the historic aspects of the surroundings and the Historic <br />District. <br /> <br />(e) <br /> <br />Each certificate of appropriateness shall be issued or refused or conditioned <br />or modified by the commission only upon and after oonsideration of the <br />factors set out in this section. <br /> <br />In considering the removal of a marker or demolition of a structure, in addition to <br /> <br /> <br />
