of the appeal to the court except that the filing of such petition shall not <br />stay the decision if such decision denies the right to raze or. demolish a <br />building or structure. <br /> <br />Sec. 40-53.7. Historic markers. <br /> <br />(a) <br /> <br />Historic markers, as designed by the commission of architectural review <br />shall be made available to the owner of any building designated as a historic <br />structure by the commission. The cost of such markers shall be borne by <br />the appropriations For street signs. <br /> <br />(b) <br /> <br />The markers shall show the date of construction and the historic <br />significance of the structure, and shall be placed on the structure or <br />adjacent to it. <br /> <br />(c) <br /> <br />It shall be unlawful for anyone to display an unauthorized marker or to <br />remove an authorized marker without the consent of the structure owner and <br />the commission. <br /> <br />See. 40-53.8. Marker removal or buildi~ demolition. <br /> <br />(a) <br /> <br />The owner of an historic building who agrees to display an official <br />marker shall not remove the marker from the building or demolish the <br />building, nor shall such owner alter its exterior appearance without <br />first applying to the commission of architectural review for approval <br />of such action, <br /> <br />(b) <br /> <br />An application to remove an official marker or to demolish or alter such <br />building shall be made in writing by the building owner to the commission <br />for investigation and report, which report shall be made within thirty (30) <br />days from the date on which the application was received, for approval or <br />disapproval. The report shall be forwarded to the building official. <br /> <br />Sec. 40-53.9. Considerations in demolition permits. <br /> <br /> Before a certificate of appropriateness is issued by the commission of architectural <br />review, upon conferring with the applicant for the permit for the demolition of a <br />building or structure in the historic district, the commission shall consider the <br />factors stated in Section 40-54. <br /> <br />Sec. 40-53.10. Action on marker removal or building demolition. <br /> <br />(a) <br /> <br />In the event that the commission of architectural review recommends <br />approval of the application to remove an official marker or to demolish or <br />alter a building as provided under the Code, the commission shall <br />immed-ialely so advise the owner. <br /> <br />(b) In the event that the commission recommends denial of the application to <br /> <br /> <br />
