(8) There shall be no retail sale of goods and merchandise on the <br /> premiseS. <br /> <br />(9) Receptions and Other such functions, for compensation, shall not be <br /> permitted. <br /> <br />(10) Breakfast ohaA be the only meal served to paying transient overnight <br /> g~aests. <br /> <br />(11) <br /> <br />A minimum of one bathroom to include a water closet, lavatory, and <br />bathtub or shower, shall be provided on each floor of the structure to <br />be occupied by guests; however, city Ccur~cil may require additional <br />bathrooms as a condition of approval of the use permit. <br /> <br />(12) <br /> <br />The use permit is subject to review at any time and may be revoked <br />after a hearing by the planning commission and the city council and a <br />finding by the city council that the use has become detrimental to the <br />surrounding neighborhood or any other reason allowed bY law. <br /> <br />(13) <br /> <br />A use pern~dt granted to an owner for a bed and breakfast inn shall <br />terminate when the owner transfers the property to another <br />individual, individuais, partnership, or corporation, Any such <br />transfer shall require a new use permit from the city council. <br /> <br />See. 40-53. Application for certificate of appropriateness. <br /> <br /> Application for a certificate of appropriateness to externally repair, maintain, <br />paint, locate, construct, reconstruct, alter, or demolish a building, structure, or <br />any other improvement in the historic district shall be made to the secretary of the <br />commission of architeeturai review or the secretary's designee in writing by the <br />owner of such building, structure, or property. <br /> <br /> None of the acts may be carried out without a certificate of appropriateness. <br /> The application for a certificate of appropriateness shat1 be accompanied by plans <br />and specifications of the part or parts of the building, structure, or other <br />improvement which are or will be subject to public view from a public street, public <br />way or public place. SUCh Plans and specifications shall show the proposed exterior <br />architectural features of such building, structure, or improvement which shall <br />include, but shall noi necessarily be limited to the general design, arrangement, <br />teXture, materials, planting and color, proposed to be used in the external repair, <br />maintenance, Painting, lOcatiOn, cOnstrUCtion, reconstruction or alteration of the <br /> building, strUcture or improvement and the type of windows, exterior doors, lights, <br /> landscaping, parking signs and other exterior fixtures and appurtenances which will <br /> be subject to public view from a public way or ether public place, <br /> The secretary of the commission of architectural review may issue in accord with <br /> the provisions of this chapter certain certificates of appropriateness.
