(1) <br /> <br />The bed and breakfast inn shall be operated in a primary residential <br />structure and not in any accessory structure. The structure to be <br />used shall have been constructed fifty (50) or more years ago or be of <br />historic significance. If it is not fifty (50) years old or more, it shah <br />be the responsibility of the applicant to establish by convincing proof <br />that the residential structure is of historic significance. <br /> <br />(2) <br /> <br />Two (2) off-street parking spaces for the owner[manager and one (1) <br />off-street space per guest room shall be required. The front yard <br />shall not be used for parking. If parking cannot be provided on the <br />site, it must be provided within 300 feet of the site. <br /> <br />(i) <br /> <br />There shall be no parking by guests on the streets. <br /> <br />(ii) <br /> <br />The municipal parking areas in Olde Towne Parking District may <br />be used to satisfy the above requirement with the approval of <br />and the issuance of parking passes by the Portsmouth Parking <br />Authority. <br /> <br />All parking passes provided to the owner of the facility by the <br />Portsmouth Parking Authority shall be accounted for by the <br />owner's keeping of a record which enumerates the date and time <br />the pass was used and by whom it was used. The record book <br />shall be available for inspection by the city at any time. <br /> <br />(3) A maximum of ten (10) guest rooms is allowed. <br /> <br />(4) <br /> <br />(2) <br /> <br />No exterior additions or alterations shall be made for the express <br />purpose of creating or maintaining a bed and breakfast inn, other than <br />those required for health, safety, or sanitation requirements. Minimal <br />decorative alterations can be made to the structure if such changes <br />are deemed to be compatible to the nature of the neighborhood. Such <br />alterations and additions that are necessary or desired must meet all <br />zoning, building, environmental and fire code regulations and must be <br />approved by the commission of architectural Review. <br /> <br />The facility shall be occupied and managed by an individual having at <br />least 51 percent ownership interest in the improved real estate upon <br />which the inn is situated. <br /> <br />(6) <br /> <br />(7) <br /> <br />Maximum length of stay for a transient paying guest is limited to <br />fourteen (14) consecutive days in any thirty (30) day period of time. <br />The holder of the use permit shall keep a current guest register <br />including names, addresses and dates of occupancy of all guests which <br />register shall be available for inspection by the city at any time. <br /> <br />For identification of the bed and breakfast inn, one wall sign of four <br />square feet is permitted. Such sign shall not be directly illuminated, <br />nor shall it contain the woz'ds "hotel" or "mo~el". Said sign shall meet <br />all zoning requirements including approval from the commission of <br />architectural review. <br /> <br /> <br />
