(b) <br /> <br />(ii) Parking and loading areas shall not be allowed in such yard .setback; <br /> <br />(iii) As a condition of approval of the certificate of appropriateness, the <br /> applicant shall be deemed to have waived any right to seek a variance <br /> or special exception from the yard setback requirements along lot Hnes <br /> adjoining singie-family property, as described in this section; <br /> <br />A landscaped buffer meeting the requirements of Landscaping GrOup 3 shall <br />be established and maintained in such yard setback. <br /> <br />Sec. 40-52.6. Speoinl lnndscaping requirements. <br /> <br /> The following regulations shall apply throughout all Historic Districts: <br /> <br />(a) <br /> <br />All private areas not covered with building or surface treatment shall be <br />landscaped with plantings, grass, pedestrian walks or similar features, in <br />character with the aesthetic objectives for the area and shall be maintained <br />in good condition. <br /> <br />(b) <br /> <br />Landscaping improvements in public areas shall be in accordance with a <br />landscaping plan prepared by a qualified landscape architect. Such plan <br />shall be in character with the aesthetic objectives for the area and shall <br />respect the quality and authenticity of materials expected in a historic area. <br /> <br />Sec. 40-52.7. Bed and brenkfa~t inn.~. <br /> <br />(a) <br /> <br />The establishment of bed and breakfast inns can not only provide an <br />alternative type of lodging for transient paying guests but the income from <br />such facilities can provide incentives for maintaining many of Portsmouth's <br />Older homes. <br /> <br />This code section is enacted on the basis of a public policy that supports <br />Portsmouth as a tourist destination of persons interested in the city's <br />architectural and historic significance. <br /> <br />Use Permit Required: <br /> <br />(1) A use permit, as provided for in Article VIII, is necessary for the <br /> establishment of a bed and breakfast inn in any of the districts where <br /> this use is permitted. <br /> <br />(e) <br /> <br />(2) A use permit may be issued by the city council after recommendation <br /> by the planning commission and a finding that the location, size, <br /> design, and operating characteristics of the proposed bed and <br /> breakfast inn will be compatible with and will not adversely affect or <br /> be materially detrimental to adjacent uses, residents, buildings, <br /> structures, or natural resources. <br /> <br />Special Regulations: <br /> <br /> <br />
