~L991~93 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 22-316 <br />THEREOF, PERTAINING TO FAILURE TO YIELD TO EMERGENCY VE~ICLES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia; <br /> <br /> 1. That Section 22-316 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 22-316. <br /> <br />Duty of drivers upon approach of emergency <br />vehicles. <br /> <br /> (a) Upon the approach of any vehicle listed in <br />subsection (a) of section 22-11 giving audible signal by <br />siren, exhaust whistle, air horn designed to give <br />automatically intermittent signals, and displaying a flashing, <br />blinking or alternating emergency light or lights, the driver <br />of every other vehicle shall immediately drive to the nearest <br />edge of the roadway, clear of any intersection of highways, <br />and shall stop and remain in such position unless otherwise <br />directed by a law enforcement officer until such vehicle shall <br />have passed. This provision shall not operate to relieve the <br />driver of any such vehicle from the duty to drive with due <br />regard for the safety of all persons using the highway, nor <br />shall it protect the driver of any such vehicle from the <br />consequences of an arbitrary exercise of such right-of-way. <br /> <br /> (b) Violation of this section shall constitute failure <br />to yield the right-of-way. <br /> <br /> 2.
