(65) <br /> <br />(c) Housing for the elderly must comply with the <br />"Special requirements for housing for the elderly" <br />contained in Chapter 7 of the Code of the City of <br />Portsmouth." <br /> <br />Multi-family residential structures exceeding the <br />height limit specified in Table 40-44-1 may be <br />erected in the RM-60 zoning district if the <br />following requirements are satisfied: <br /> <br />(a) City council must issue a group housing use <br />permit. <br /> <br />(b) The required building setback from any <br />property line shall be increased by one (1) foot <br />for each two (2) feet in building height aboue 45 <br />feet. <br /> <br />(c) The total floor area devoted to residential <br />purposes shall not exceed the total lot area of <br />the zone lot on which the structure is erected. <br /> <br />(76) Limited to a dwelling unit located above the <br /> ground floor in a non-residential structure. <br /> <br /> 2. That Sections 40-43.5, 40-43.6, 40-44.1(a) and (b), <br />40-52.1(a) and (b), 40-56.1, 40-62.1(3), 40-71.2(e), <br />40-71.3(a), 40-178.1, 40-179.1(a), 40-195 and 40-196(c) and <br />(e) of the Code of the City of Portsmouth, Virginia, 1988, be <br />amended to read as follows: <br /> <br />Section 40-43.5 <br /> <br />Non-residential uses -- buffering <br />requirement. <br /> <br /> Any commercia~ or industrial use, not located in an <br />historic district but located on a zone lot adjoining any zone <br />lot in an RS, RT, RM, or historic zoning district and which is <br />vacant property or is actually used for one or more dwellings, <br />shall comply with the following buffering requirements along <br />all lot lines adjoining such property: <br /> <br />(a) <br /> <br />The yard setback on the commercial or industrial <br />side of the property line shall be the same as <br />required by the zoning of the adjoining property, <br />regardless of whether the commercial or industrial <br />use is in the same district, and the yard setback <br />requirements when applied to a structure shall be <br />increased by one (1) foot for each foot of height of <br />such structure above 36 feet. <br /> <br />(b) <br /> <br />A landscaped buffer meeting the requirements <br />landscaping group 1 shall be established and <br />maintained in such yard setback. <br /> <br />of <br /> <br /> <br />
