AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, 1988, BY AMENDING SECTIONS 40-43.4, 40-43.5, 40-43.6, 40-44.1[a) AND (b), 40-52.1(a) AND (b), 40-56.1, 40-61.1(3), 40-71.2(e), 40-71.3(a), 40-73.1, 40-178.1, 40-179.1(a), 40-195, 40-196(c) AND (e) THEREOF, AND BY ADDING SECTION 40-45.8 THERETO, PERTAINING TO ZONING. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: t. That Section 40-43.4 of the Code of the City of Portsmouth, Virginia, 1988, be amended by repealing Conditions (11), (24) through (27), (29), (31). (35), (36), (39), (40), (43), (45), (47), (50) through (52) and (54), by adding Conditions (23), (37), and (76), and by amending Conditions (64) and (65) thereof, to read as follows: Section 40-43.4. Conditions for specific uses. The following conditions apply to the specified uses, as indicated in the "Condition" column on the Use Schedule: (23) Mobile homes are permitted only in the Residential Mobile Home RMH zoning district, subject to the requirements of Article VIII of this Chapter and the requirements of Chapter 21 of the Code of the City of Portsmouth. (37) (a) Chapter 9 of the Code of the City of Portsmouth prohibits establishment or enlargement of cemeteries. (b) Animal cemeteries are not permitted in any zoning district. (64) (a) The parking requirements for housing for the elderly may be modified by city council as provided in section 40-45.1. (b) The minimum floor area requirement for housing for the elderly may be reduced by city council to no less than 475 square feet of floor area per unit for one-bedroom efficiency dwelling units through the approval of a group housing use permit. No such reduction shall be authorized except upon assurances satisfactory to the council that such housing is designed exclusively as housing for the elderly as defined by this chapter. After such reduction has been authorized the premises shall not be used other than for housing for the elderly unless and until compliance with the minimum required floor area applicable to the new use has been demonstrated.
