for the purpose, whether immediate or future, of transfer of ownership or of <br />building development, including all changes in existing street or lot lines and any <br />new streets; provided, however, that divisions of land into parcels of three (3) <br />acres or more not involving any new street or easement shall not be deemed a <br />subdivision; and further, provided that any subdivision to which the city or the <br />Commonwealth of Virginia is a party shall not be deemed a subdivision. <br /> <br /> TEMPORARY RESIDENCE FACILITY. Any facility to provide emergency group <br />living accommodations as a single housekeeping unit for up to ninety (90) days for <br />the maintenance and care of adults, children and fam2lies in need of emergency <br />housing including, but not limited to, facilities qualified to be licensed by the City <br />of Portsmouth or the Commonwealth of Virginia. <br /> <br /> TOURIST HOME. A principal building wherein from one to ten (10) rooms are <br />rented as an incidental home occupation to provide overnight accommodations for <br />transient guests. <br /> <br />TOWNHOUSE. See DWELLING~ ATTACHED ROW. <br /> <br />USE. The activity or function that actually takes place or is intended to take place <br />on a lot or premises or in any structure thereon. <br /> <br /> USE, ACCESSORY. A use which is cleariyminor and incidentai to and customarily <br />found in connection with the principal use of the premises and which is located on <br />the same zone lot as the principal use; provided, however, that parking lots <br />conforming To the requirements of Section 40-45.4 may be located on a different zone <br />lot than the principal use. <br /> <br /> YARD. A space on the same zone lot with a principal building, open, unoccupied, <br />and unobstructed by buildings from the ground to the sky, except where <br />encroachments and accessory buildings are expressly permitted by this Chapter. <br /> <br />YARD, FRONT. A yard extending across the full width of the zone <br />lot adjoining the street upon which the zone lot fronts. <br /> <br />YARD, REAR. A yard extending across the full width of the plot adjoining the rear <br />plot line. <br /> <br />YARD, SIDE.
