Section 22-392. <br /> <br />Specific instances of reckless driving - <br />Generally. <br /> <br />(1) <br /> <br />Drive a vehicle which is not under proper control or <br />which has inadequate or improperly adjusted brakes <br />upon any highway of this city. <br /> <br />Section 22-425. General penalty. <br /> <br /> (b) Any person convicted of a second offense within less <br />than five (5) years after a first offense under section 22-421 <br />shall be punishable by a fine of not less than two hundred <br />dollars ($200.00) nor more than two thousand five hundred <br />dollars ($2,500.00) and by confinement in jail for not less <br />than one (1) month nor more than one (1) year. Forty-eight <br />(48) hours of such confinement shall be a mandatory, minimum <br />sentence not subject to suspension by the court. Any person <br />convicted of a second offense within a period of five (5) to <br />ten (10) years of a first offense under section 22-41 shall be <br />punishable by a fine of not less than two hundred dollars <br />($200.00) nor more than two thousand five hundred dollars <br />($2,500.00) and by confinement in jail for not less than one <br />(t) month nor more than one (1) year. Any person convicted of <br />a third offense or subsequent offense within ten [10) years of <br />an offense under section 22-421 shall be punishable by a fine <br />of not less than five h~ndred dollars ($500.00) nor more than <br />two thousand five hundred dollars ($2,500.00) and by <br />confinement in jail for not less than two (2) months nor more <br />than one (1) year. Thirty (30) days of such confinement shall <br />be a mandatory, minimum sentence not subject to suspension by <br />the court if the third or subsequent offense occurs-within <br />less than five (5) years. Ten (10) days of such confinement <br />shall be a mandatory, minimum sentence not subject to <br />suspension by the court if the third or subsequent offense <br />occurs within a period of five (5) to ten (10) years of a <br />first offense. <br /> <br /> (c) For the purpose of this section, a conviction, or <br />finding of not innocent in the case of a juvenile, under the <br />provisions of section 22-421, or as provided under section <br />18.2-270 of the Code of Virginia, shall be considered a prior <br />conviction. <br /> <br />Section 22-427. Driving after forfeiture of license. <br /> <br /> If any person convicted of a violation of section 22-421 <br />shall, during the time for which he is deprived of his right <br />so to do, drive or operate any motor vehicle, engine or train <br />in this city, he shall be guilty of a Class 1 misdemeanor. <br /> <br /> <br />
