AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 22-72(a), 22-348(a), 22-392(1), 22-425(b) AND (c), 22-427, AND 22-574(b) THEREOF, PERTAINING TO MOTOR VEHICLES AND TRAFFIC. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 22-72(a) of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 22-72. Levy and purpose of tax. (a) For each year beginning with January first thereof and ending with December thirty-first following until otherwise changed, there is hereby levied and there shall be collected from every person owning a motor vehicle, trailer or semitrailer, which is normally garaged, stored or parked within the city limits, a license tax on such motor vehicle, trailer or semitrailer at the rates set forth in this article. In the event it cannot be determined where a vehicle is normally garaged, stored or parked, or if the owner is a student attending an institution of higher education, the situs for the purpose of imposing the license tax shall be the domicile of the owner of the vehicle. 2. That Sections 22-348[a), 22-392(1), 22-425(b) and (c), 22-427, and 22-574(b) be amended to read as follows: Section 22-348. Driving while license suspended or revoked. (a) Except as otherwise provided in section 22-42B of this chapter and section 46.2-357 of the Code of Virginia, no resident or nonresident, whose driver's license, learner's permit, or privilege to drive a motor vehicle has been suspended or revoked or who has been directed not to drive by any court or by the commissioner of the state department of motor vehicles or by operation of law pursuant to the provisions of this chapter, title 46.2 of the Code of Virginia, or any similar law or regulation or who has been forbidden as prescribed by law by the commissioner of the state department of motor vehicles, the state corporation commission, the commonwealth transportation commissioner, any court, or the superintendent of state police to operate a motor vehicle in this commonwealth shall thereafter drive any motor vehicle or any self-propelled machinery or equiDment on any highway in this city unless and until the period of such suspension or revocation shall have terminated.
