OPEN BURNING. Any burning of combustible materials wherein the products of
<br />combustion are emitted directly into the open air without passing through a stack or
<br />chimney.
<br />
<br /> OWNER. Any person or government agency having a legal or equitable right to
<br />repair, maintain, paint, locate, reconstruct, alter, or demolish a building,
<br />structure, or other improvement.
<br />
<br />PARKING SPACE. The standing storage space for one automobile.
<br />
<br /> PENNANT. Any lightweight plastic, fabric, paper or the material, whether or not
<br />containing a message of any kind, suspended from a rope, wire, or string, usually
<br />in series, designed to move in the wind.
<br />
<br />PERSON. Any person, firm, partnership, association, corporation, company, or
<br />organization, singular or plural of any kind.
<br />
<br />PLANNING CO,~vSMISSION. The planning commission of the city.
<br />
<br />PLANNING DEPARTMENT. That department of the City of Portsmouth identified in
<br />Chapter 2, Article iX of the City Code.
<br />
<br />PLANNING ~RECTOR. That person designated as the director of the Planning
<br />Department of the City ef Portsmouth.
<br />
<br />PUBLIC BODY. Any government or governmental agency of the City of Portsmouth,
<br />the Commonwealth of Virginia, or of the United States of America.
<br />
<br /> RECYCLE DROP BOX. A receptacle used To collect recyclable materials such as
<br />newspapers, glass, clothing and other similar materials but does not include truck
<br />trailers stored on property for more than one month.
<br />
<br /> RECYCLABLE l~akTERIALS. Reusable material including but not limited to metals,
<br />glass, plastic and paper, which are intended for reuse, manufacture, or
<br />reconstitution for the purpose of using the altered form. Recyclab]e material does
<br />not include refuse or hazardous materials.
<br />
<br /> RECYCLING PLANT. A totally enclosed building within which the receipt,
<br />separation, storage, conversion, baling and/or processing of paper, iron, metal,
<br />glass, newspaper, and other non-biodegradable recyclable materials can occur for
<br />the purpose of reutilization of such materials. Hazardous and bio-degradable
<br />materials including, but not limited to, food, beverages, drugs, cosmetics,
<br />hazardous chemicals, poisons, medical wastes, syringes, needles, pesticides and
<br />other similar materials shall not be brought into or handled by a recycling plant.
<br />
<br /> RECYCLING STATION. A facility designed and operated to receive, purchase,
<br />store and redistribute recyclable materials. Power driven processing equipment is
<br />not permitted at this facility.
<br />
<br />RESIDENTIAL USE. Any use permitted by this code in a residential district.
<br />
