and intended as a unit for the purpose of transfer of ownership. LOT, FLAG. A lot, the building area or principal use area of which does not abut a public street, but is connected thereto by a narrow strip of land (the "flagpole" or "l~anhandle" ), which is part of the lot. LOT, ZONE AREA. The total area circumscribed by the boundaries of a lot. See method of computation and certain limitations in Section 40-44.5. LOT, ZONE. A parcel of land in one ownership, which is of at least sufficient size to meet minimum zoning requirements for use, coverage, and area, and to provide such yards and other open spaces as are required by this Cl*mpter. Such zone lot may consist of: a single lot of record; a portion of a lot of record, if the existence of such portion does not result from a violation of ChapTer 33 or its predecessors; a combination of two or more lots of record or of complete lots and/or portions Of lots of record if the existence of any s~cb portion does not result from a violation of Chapter 33 or its predecessors. MOBILE CONSTRUCTION EQUIPMENT. Any vehicle or equipment not designed or used primarily for the transportation of persons or property and only incidentally operated or moved over highways or streets, including, but not limited to, ditch- digging apparatus, asphalt spreaders, cement mixers, brush chippers, wheel backhoes,~ loaders, ditchers, finishing machines, motor graders, road rollers, searifiers, scrapers, excavators, drag lines, cranes, and earth-moving equipment. MOBILE HOME. Any factory assembled vehicle with necessary service connections which is mounted or designed to be mounted on wheels and which is permanently used or intended for permanent, long-term use as a dwelling, but not including parked and unoccupied camping type trailers. Any such vehicle shall be deemed to be a mobile home whether or not the wheels have been removed therefrom and whether or not resting upon a temporary or permanent foundation. MOBILE HOME PARK. Any tract of land of at least ten (10) contiguous acres under unified ownership used for the rental of mobile home lots which will provide a satisfactory living environment for mobile home residents on a long-term occupancy basis. MOBILE HOME SUBDIVISION. Any tract of land divided into two (2) or more lots for the purpose of sale of such lots to mobile home owners to be developed and used as mobile home sites. NONCONFORMING SIGNS. Any sign which does not conform to the regulations of the related codes and ordinances of the City of Portsmouth. NONCONFORMING STRUCTURE. A legally existing building or structure which fails to comply with the dimensional regulations set forth in this code, applicable to the district in which such structure is located. NONCONFORMING USE. A legally existing use of land or building which fails to comply with theallowed or permitted uses in Article III of this chapter, either at the effective date of this chapter, or as a result of subsequent amendments to this chapter.
