AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 30-26, 30-116(c), 30-151, 30-236(a), (b) AND (c), 30-237(b), (c) AND (d), THEREOF, AND BY ORDAINING SECTION 30-237(e), ALL PERTAINING TO RETIREMENT. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: t. That Section 30-26 of the Code of the City of Portsmouth, Virginia, 1988, be amended by amending the definition of "Creditable service" contained therein to as follows: read ' Section 30-26. Definitions. Creditable Service. The term "creditable service" means for any member, the most recent period of continuous service as an employee rendered by the member plus membership service for which credit is allowed under this chapter; provided, however, that periods before and after periods of unpaid authorized leave shall be included as creditable service but the period of leave itself shall not be credited as creditable service. In addition, under regular service retirement and excluding deferred or vested retirement, one-half of unused sick leave as of the effective date of retirement shall be added to creditable service. 2. That Section 30-116(c) of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 30-116. Service retirement. (c) Any member who terminates service as an employee prior to retirement and who complies with one of the requirements set forth in (1), (2), (3), (4) or (5) below, and who has attained the age of sixty (60), may retire at any time then or thereafter under the provisions of subsection (a) of this section: (5) Membership began after June 30, termination occurred after the completion creditable service. 1991, and of five (5) years of 3.
