Section 30-151. Definitions. Creditable Service. The term "creditable service" means for any member the most recent period of continuous service as an employee rendered by the member plus membership service for which credit is allowed under this Article; provided, however, that periods before and after periods of unpaid authorized leave shall be included as creditable service but the period of leave itself shall not be credited as creditable service. In addition, under regular service retirement and excluding deferred or vested retirement, one-half of unused sick leave as of the effective date of retirement, shall be added to creditable service. 4. That Sections 30-236(a), (b) and (c) of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 30-236. Service retirement. (a) Any member in service who has attained the age of fifty (50) and who has attained the number of years of creditable service required for entitlemen~ to benefits under the vesting provisions of this section or has completed twenty (20) years of creditable service may retire at any time then or thereafter, upon written notification to the board, made by the member or his employer, setting forth at what time the retirement is to become effective; provided that such effective date shall be after his last day of service, but shall not be more than ninety (90) days prior to or subsequent to the filing of such notice. (b) The provisions of subsection (a) of this section to the contrary notwithstanding, after June 30, 1992 any member remaining in service after his normal retirement date who attains sixty-two (62) years of age shall be retired forthwith. (c) Any member who terminates service as an employee prior to retirement and who complies with one of the requirements set forth in (1), (2), (3), (4), or (5) below, and who has attained the age of sixty (60), may retire at any time then or thereafter under the provisions of subsection (a) of this section: (5) Membership began after June 30, 1991, and termination occurred after the completion of five (5) creditable service. years of 5.
