AN ORDINANCE TO AMEND CHAPTER 12 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY ENACTING SECTION 12-121 PERTAINING TO AN ADDITIONAL TWO DOLLAR FEE AS PART OF THE ASSESSED COSTS IN THE CIRCUIT COURT AND THE GENERAL DISTRICT COURT OF--THE CITY OF PORTSMOUTH, VIRGINIA, TO BE USED FOR THE CONSTRUCTION, RENOVATION OR MAINTENANCE OF THE COURTHOUSES, JAIL, OR COURT-RELATED FACILITIES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 12-121 of the Code of the City of Portsmouth, Virginia, 1988, be enacted to read as follows: Section 12-121. Fee for the construction, renovation or maintenance of the courthouses, jail, or court-related facilities. There is hereby imposed for the construction, renovation or maintenance of the courthouses or jail and court-related facilities an assessment in the sum of two dollars ($2.00), as part of the costs incident to criminal or traffic cases filed in the Circuit Court and General District Court, located within the boundaries of the City. The assessment shall be collected by the Clerk of the Court in which the action is filed, and remitted to the Treasurer. Disbursements shall be as authorized by the City Council for the construction, renovation or maintenance of courthouses or jail and court-related facilities and to defray increases in the cost of heating, cooling, electricity, and ordinary maintenance. The assessment provided for herein in the sum of two dollars ($2.00) is in addition to the amount of Clerk's fees or court costs already imposed or assessed for traffic or criminal cases and shall be in addition to any other fees prescribed by law. 2. The provisions of this ordinance shall take effect on July 1, 1991. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held May 14, 1991. Teste: City Clerk
