1991-31 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 36 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 36-51, 36-52, <br />36-53[2) AND TABLE 36.1 THEREOF, AND BY ADDING SECTION 36-56 <br />THERETO PERTAINING TO TREE PLANTING AND REPLACEMENT. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 36-51 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding the <br />definitions "construction footprint" and "multi-stem tree" <br />read as follows: <br /> <br />to <br /> <br />Section 36-51. Definitions. <br /> <br />Construction footprint - The area of all impervious surfaces <br />including, but not limited to, buildings, roads and drives, <br />parking areas, sidewalks, and the area necessary for <br />construction of such improvements. <br /> <br />Multi-stem tree - A tree having more than one trunk emerging <br />from the root system. <br /> <br /> 2. That Sections 36-52 and 36-53[2) of the Code of <br />City of Portsmouth, Virginia, 1988, be amended to read as <br />follows: <br /> <br />the <br /> <br />Section 36-52. <br /> <br />Standards for planting and replacement of <br />trees. <br /> <br />(1) <br /> <br />Any preliminary or final subdivision plat submitted in <br />accordance with the Subdivision Ordinance, Chapter 33 of <br />the City Code, which creates a lot or lots, any site <br />development plan submitted in accordance with the Zoning <br />Ordinance, Chapter 40 of the City Code, and any <br />application for a building permit for a new principal <br />residential structure, shall include a landscape plan. <br />The landscape plan must be drawn to the same scale as the <br />plat or site development plan and shall clearly indicate <br />trees to be retained or planted to meet the requirements <br />of this Article. Trees to be retained on the site shall <br />be clearly indicated by common and botanical names, their <br />actual location on the site, and the extent of the site <br />covered by the canopy of each tree. Stands of five (5) <br />or more trees may be grouped together and shall indicate <br />the overall area to be encompassed by their canopies. <br />Critical protection zones for all trees to be retained, <br />as well as a description of any protective devices <br />proposed to comply with Section 36-52 (10) shall be <br />indicated.
