ARTICLE XIV. ADMINISTRATION AND INTERPRETATION <br /> <br /> DIVISION 1. GENERAL PROVISIONS <br /> <br />Sec. 40-171. Applicability. <br /> No buil {ding or land shall be used and no building or part thereof shall be erected, <br />moved or modified unless its use, erection, or modification is in conformance with the <br />provisions of this Cede and all approvals required herein have been granted. No <br />building permit shall be issued for the erection of any structure or building in any <br />subdivision in the city unless all required plats have been filed for record as <br />provided in this Code. <br /> <br />See. 40-171.1. Downtown D-1 and D-2 districts. <br /> Without limiting the foregoing, no building or other improvements on land in the <br />Downtown D-] or D-2 Districts shall be erected, moved or modified, unless its use, <br />erection, or modification is consistent with a certificate approved by the downtown <br />design committee. <br /> <br />Sec. 40-171.2. Historic districts. <br /> Also without limiting the foregoing, no improvement, except those not subject to <br />public view from a public street or way, in any Historic District shall be externally <br />repaired, maintained, painted, located, constructed, reconstructed, altered, or <br />demolished unless a certificate of appropriateness IS issued by the commission of <br />architectural review of applicable jurisdiction. <br /> <br />Sec. 40-172. Site development plan review required. <br /> In addition to all of the other requirements of this Chapter, no excavation or <br />building permit shall be issued until the director has reviewed a site development <br />plan and certified that the site development plan conforms to applicable regulations <br />of this Chapter, Chapter 33 (Subdivision Ordinance), Chapter 39 (Wetlands Zoning <br />Ordinance) and Chapter 9.1 (Chesapeake Bay preservation Area Overlay District <br />Ordinance), and Chapter 36 (Tree Replacement Ordinance), except as follows: <br /> <br /> (a) No site development plan review shall be required for agricultural uses or <br /> for one-family or two-family detached dwellings; unless such review is <br /> required by the State Chesapeake Bay Preservation Act and any regulations <br /> or ordinances adopted under authority thereof. <br /> <br /> (b) The city engineer nmy waive part or all of the site development plan <br /> requirements for additions to buildings, structures or uses if, in his <br /> opinion, such addi'~ion does not substantially deviate from the purposes and <br /> intent of this article and said addition is equivalent to 25 per cent or less of <br /> the total of the existing square footage of gross floor area and paved <br /> <br />123 <br /> <br /> <br />
