ARTICLE X. EXCAVATION USE PERM[TS <br /> <br />See. 40-121. Applicability. <br /> <br /> An excavation use permit shall be obtained from the city council prior to <br />excavation or removal of soils, sand, clay, gravel or any combination of these for the <br />purpose of operating a borrow pit from which the excavated material will be sold. <br />Such restriction shall not apply To excavation or building construction for which a <br />building permit has been obtained. Nor shall it apply to the construction of streets, <br />driveways, utilities, agricultural farm ponds, or sanitary disposal systems for which <br />permits have been issued. <br /> <br />Sec. 40-121.1. Application. <br /> <br /> An excavation use permit application shall contain the information specified in this <br />section and shali be accompanied by the application fee specified in Article XII. <br /> <br />An application for an excavation use permit shall include the following information: <br /> <br />(a) The names and addresses of owners of all property abutting on property for <br /> which the permit is sought. <br /> <br />(b) <br /> <br />An identification plat, prepared by an engineer or land surveyor, certified <br />by the commonwealth, drawn to a scale of not less than one inch equals one <br />hundred (100) feet, submitted in five (5) copies. This plat shall show: <br /> <br />(i) The means of vehicular access to the proposed excavation. <br /> <br />(fi) <br /> <br />(iii) <br /> <br />(iv) <br /> <br />The number of cubic yards to be excavated. <br /> <br />The areas proposed for the storage of over-burden and other soil <br />during the excavation process. <br /> <br />The proposed date on which excavation shall commence, the proposed <br />date on w,hich the excavation shall be completed, and the proposed <br />date that all required restoration measures are to be completed. <br /> <br />(v) The location of all haul roads leading to public streets and highways <br /> within the area. <br /> <br />(vi) A statement listing the public streets and highways to be used as haul <br /> rou~es. <br /> <br />(vii) Staged and final contours. <br /> <br />(viii)Restoration plan, as specified by this Code. <br /> <br />115 <br /> <br /> <br />
