Sec. 40-122.4. Fee for ~emoval of excavated material. <br /> <br /> The owner or operator shall submit a written application to the commissioner of <br />Revenue for a license to excavate. The license shall be obtained in advance or <br />portion thereof beginning each quarter, January 1st, April Ist, July 1st or October <br />1st, in which the owner or operator intends to excavate, and the application shall <br />include an estimate of the number of cubic yards to be excavated. Upon application <br />aU each such quarter, or portion thereof, the owner or operator shall pay, in <br />advance, the fee for each cubic yard of material estimated to be removed within that <br />particular quarter, or portion thereof. At the end of the quarter, the actual <br />excavation records shall be furnished to the commissioner of revenue, and <br />adjustments shall be made ~o insure that the owner only pays for the cubic yards <br />removed. <br /> <br />Sec. 40-123. ~-ior permits recognized. <br /> <br /> Nothing in t~his Article shall apply to any project previously granted a permit to <br />operate a barrow pit, except for the registration requirement for existing operations <br />and the levy of fees for removal and sale of excavated material commencing after July <br />1, 1977. <br /> <br />Sees. 40-124- 40-1~0.
