for a particular use only if it finds that the issuance of the use permit: (a) Will not adversely affect the health or safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public we]fare or injurious to property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will permit a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accord with the purposes of this chapter. In granting any use permit, the city council shall designate such conditions in connection therewith as will, in its opinion, assure that the use will conform tc the foregoing requirements and that it will continue to do so. Sec. 40-106.1. Expiration of use permits. If a building permit for the allowed use is not issued within two (2) years of the date the council approved the use, the use permit shall automatically become void. Prior to, and within three (3) months of, the expiration of the permit, if the applicant gives satisfactory evidence that progress is being made toward development of the approved use, the planning commission may grant a one (1) year extension of the permit. Sec. 40-106.2. Revocation of use permits. A use permit may be revoked or modified by city council action after notice and public hearings meeting the requirements set forth in the Code of Virginia for a rezoning, for either of the following reasons: (a) That the use permit was obtained or extended by fraud or deception; (b) That one or more of the conditions designated by city council has not been met or has been violated. DIVISION 2. MOBILE HOME PARKS Sec. 40-107. Application. An application for a Residential Mobile Home (RMH) use permit for a mobile home park shall include all of the materials required for an application for a use permit under Section 40-105.1 and a preliminary plat as required by Section 33-73. 108
