for a particular use only if it finds that the issuance of the use permit: <br /> <br />(a) Will not adversely affect the health or safety of persons residing or working <br /> in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public we]fare or injurious to property or <br /> improvements in the neighborhood; <br /> <br />(c) <br /> <br />Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) <br /> <br />Will permit a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br />(e) Will be in accord with the purposes of this chapter. <br /> <br /> In granting any use permit, the city council shall designate such conditions in <br />connection therewith as will, in its opinion, assure that the use will conform tc the <br />foregoing requirements and that it will continue to do so. <br /> <br />Sec. 40-106.1. Expiration of use permits. <br /> <br /> If a building permit for the allowed use is not issued within two (2) years of the <br />date the council approved the use, the use permit shall automatically become void. <br />Prior to, and within three (3) months of, the expiration of the permit, if the <br />applicant gives satisfactory evidence that progress is being made toward <br />development of the approved use, the planning commission may grant a one (1) year <br />extension of the permit. <br /> <br />Sec. 40-106.2. Revocation of use permits. <br /> <br /> A use permit may be revoked or modified by city council action after notice and <br />public hearings meeting the requirements set forth in the Code of Virginia for a <br />rezoning, for either of the following reasons: <br /> <br /> (a) That the use permit was obtained or extended by fraud or deception; <br /> <br /> (b) That one or more of the conditions designated by city council has not been <br /> met or has been violated. <br /> <br />DIVISION 2. MOBILE HOME PARKS <br /> <br />Sec. 40-107. Application. <br /> <br /> An application for a Residential Mobile Home (RMH) use permit for a mobile home <br />park shall include all of the materials required for an application for a use permit <br />under Section 40-105.1 and a preliminary plat as required by Section 33-73. <br /> <br />108 <br /> <br /> <br />
