ARTICLE VIII. USE PERMITS <br /> <br /> DIVISION 1. GENERALLY <br /> <br />Sec. 40-101. Use permits. <br /> <br /> An application for a Use Permit shall be submitted, reviewed and processed in <br />accordance with the requirements of this Article. <br /> <br />Sec. 40-102. Exception for excavation use permits and group housing use permits. <br /> <br /> Because of the unique nature of excavation use permits, the procedure for <br />reviewing application for such permits shall be the procedure in Article X and not <br />the procedure in this Article. Because of the unique nature of group housing use <br />permits, the procedure for reviewing application for such permits shall be the <br />procedure in Article IX and not the procedure in this Article <br /> <br />Sea. 40-i03. Procedures. <br /> <br /> The application shall be processed in accordance with the procedures of Article <br />VII for a rezoning. The posting of signs, publishing of legal notices and other <br />procedures with respect to petitions for amendments of ibis chapter as provided in <br />Article VII shall be observed and followed. <br /> <br /> When transmitting any such application to the city council, the planning director <br />shall append thereto reports and comments of any interested department head. <br /> <br />Sec. 40-104. Lira{ration on applications. <br /> <br /> No application for a use permit shall be accepted by the planning director within <br />one year of the final action of the city council upon a prior application concerning <br />the same use and the same building, if any, on substantially the same land. <br /> <br />Sec. 40-105. Application for use permits. <br /> <br /> An application for a use permit shall be made in writing to the planning director, <br />by the prospective occupant and acknowledged by the owner of the property. Each <br />application shall be accompanied by the applicable fee. <br /> <br />Sec. 40-105.1. Contents. <br /> <br />An application for a use permit shall contain the following information: <br /> <br />(a) <br /> <br />A letter from the applicant clearly describing the proposed use and all <br />processes and activities involved with the proposed use, and information on <br />permanent landscaping maintenance arrangements. <br /> <br />106 <br /> <br /> <br />
